Nevada Juvenile Detention Sexual Abuse Litigation

DiCello Levitt represents survivors in a civil rights lawsuit alleging that children confined in Nevada juvenile detention facilities were sexually abused, exploited, and silenced by adults responsible for their safety.

No child should ever be harmed by adults entrusted with their safety. Our clients are bravely coming forward to seek accountability and justice for abuse that never should have happened. Their courage sends a powerful message to others who have not yet been able to come forward: they are not alone.

—Timothy R. O’Reilly, Counsel for Plaintiffs

This ongoing civil rights litigation seeks accountability for the alleged sexual abuse of children confined in Nevada juvenile detention and correctional facilities. The plaintiffs allege that, while minors in state or county custody, they were subjected to sexual exploitation, coercion, intimidation, and retaliation by those entrusted with their safety and care.

DiCello Levitt represents survivors who allege that Nevada state and county officials ignored warning signs and complaints, failed to maintain safe reporting systems, and allowed a culture of silence and impunity to persist. The lawsuit asserts federal civil rights claims under 42 U.S.C. § 1983, along with Nevada state-law claims including sexual assault, sexual battery, negligence, negligent hiring, training and supervision, intentional infliction of emotional distress, and declaratory relief.

Case Overview

Children placed in government custody should be protected from harm. This lawsuit alleges that, for many youth confined in Nevada juvenile detention facilities, the institutions responsible for their safety instead became places of abuse, exploitation, and silence.

Allegations of Sexual Abuse in Nevada Juvenile Detention Facilities

Spanning more than two decades, the allegations describe sexual abuse, coercion, and intimidation of children confined in state- and county-operated juvenile detention and correctional facilities. The facilities identified in the complaint include Caliente Youth Center, Nevada Youth Training Center, Summit View Youth Center, China Spring Youth Camp, and Clark County Juvenile Detention Center.

The plaintiffs were minors committed to Nevada’s juvenile justice system by court order. Unable to leave or escape staff authority, they depended on the institutions holding them for basic necessities, medical care, education, family communication, and personal safety.

According to the complaint, staff and other institutional actors exploited that power imbalance to manipulate, threaten, and silence children. Some plaintiffs allege they were threatened with punishment, extended confinement, loss of privileges, solitary confinement, or other retaliation if they reported abuse. Others describe being given food, tobacco, alcohol, or other items in exchange for their silence.

Institutional Failures and a Culture of Silence

Beyond the alleged abuse itself, the litigation challenges what plaintiffs describe as systemic failures by Nevada state officials, Clark County, Douglas County, facility administrators, supervisors, and other defendants.

The plaintiffs allege that officials failed to implement adequate safeguards, investigate credible complaints, properly supervise staff, and remove known abusers. The complaint also describes failures to maintain confidential reporting systems, meet abuse-prevention obligations, and provide trauma-informed care to vulnerable youth.

For children who attempted to speak out, the consequences could be severe. According to the complaint, reports of abuse were ignored, dismissed, or left without meaningful investigation. Grievance procedures were allegedly unknown, inaccessible, or ineffective, leaving children with little confidence that reporting misconduct would lead to protection rather than retaliation.

Federal Civil Rights and Nevada State-Law Claims

The lawsuit asserts federal civil rights claims under 42 U.S.C. § 1983, alleging violations of the Fourth, Eighth, and Fourteenth Amendments to the U.S. Constitution. These include claims involving unreasonable seizure, failure to protect, substantive due process, equal protection, cruel and unusual punishment, and denial of medical care.

The plaintiffs also bring claims of municipal liability under Monell, alleging that unconstitutional policies, customs, inadequate training, and ratification of misconduct contributed to the alleged abuse.

Additional Nevada state-law claims include sexual assault, sexual battery, negligence, negligent hiring, training and supervision, intentional and negligent infliction of emotional distress, constructive fraud, and declaratory relief.

Seeking Accountability for Survivors of Juvenile Detention Abuse

Through this litigation, survivors seek accountability from the individuals and public institutions they allege failed to protect them. The lawsuit seeks damages and other available legal and equitable relief for the harm they allegedly suffered while confined in Nevada’s juvenile justice system.

The case is John Doe 319304, et al. v. Laura Rich, et al., Case No. 2:26-cv-01016, in the U.S. District Court for the District of Nevada. The DiCello Levitt legal team includes Timothy R. O’Reilly and Doug Rochen.
