Partner Dan Schwartz Leads Firm Team in In re Adobe Data Tracking Litigation
On October 1, 2025, Judge Noël Wise of the United States District Court for the Northern District of California appointed DiCello Levitt as Interim Co-Lead Counsel in a data privacy class action against Adobe.
The consolidated class action, In re Adobe Data Tracking Litigation, alleges the multinational software company secretly tracks and monetizes consumers’ online data without their knowledge or consent. According to the complaint, Adobe secretly collects data across thousands of websites, all of which is used by Adobe for its own benefit, including developing individually identifiable user profiles. The complaint also alleges that Adobe’s tracking technology employs domain spoofing techniques and this case will be an important first challenge of this emerging and troubling practice.
