DiCello Levitt Partner Daniel Schwartz Quoted in Law.com About Cases Involving Alleged Theft of Affiliate Marketing Commissions

DiCello Levitt Partner Daniel Schwartz is quoted in a Law.com article, “‘Reverse Robin Hood’: Capital One Swarmed With Class Actions Alleging Theft of Influencer Commissions in January.” The article covers at least eight recent class actions filed against Capital One about its alleged theft of influencers’ marketing commissions. According to the claims, the company’s Shopping browser extension replaces influencers’ affiliate links with its own tracking cookies, diverting sales commissions to Capital One.

On January 22, 2025, Cohen Milstein Sellers & Toll, HammondLaw, and DiCello Levitt filed a class action lawsuit against Capital One Financial Corporation, Wikibuy LLC, and Wikibuy Holdings, LLC on behalf of Edgar Oganesyan, Matthew Ely, and other social media influencers. The lawsuit alleges that defendants’ Capital One Shopping browser extension has been systematically stealing affiliate marketing commissions.

PayPal also faces similar class actions over its browser extension, Honey. On January 3, 2025, DiCello Levitt filed a class action lawsuit against PayPal, Inc. and PayPal Holdings, Inc. on behalf of Claudia Jayne Young and other affiliate marketers—content creators who include bloggers, podcasters, and influencers. The lawsuit alleges that PayPal has been systematically stealing affiliate marketing commissions through its Honey browser extension and PayPal Rewards program.
