DiCello Levitt Partner J. Gordon Bergstresser Elected to Leadership of AAJ Over-Designation Litigation Group

Aug 06, 2026

Appointment Recognizes Bergstresser’s Experience With Complex Discovery, Protective Orders, Privilege Issues, and Electronically Stored Information

WASHINGTON – DiCello Levitt is pleased to announce that Partner J. Gordon Bergstresser has been elected to the leadership of the American Association for Justice’s (AAJ’s) Over-Designation Litigation Group.

The appointment recognizes Gordon’s experience with electronically stored information (ESI), complex discovery, protective orders, privilege disputes, and the strategic management of large document productions. In this leadership role, he will help support the Litigation Group’s efforts to provide plaintiffs’ attorneys with practical tools, shared knowledge, and effective strategies for addressing discovery abuse.

The Over-Designation Litigation Group focuses on the improper designation of documents as confidential or privileged. Over-designation can prevent plaintiffs from obtaining relevant evidence, conceal documents involving potential fraud or public safety risks, and keep important information under seal during and after litigation. The group helps AAJ members challenge overbroad protective orders, unsupported privilege claims, and the improper designation of nonconfidential materials.

AAJ is a national organization of trial lawyers dedicated to promoting a fair and effective civil justice system. Through advocacy, education, professional resources, and collaboration among plaintiffs’ attorneys, AAJ works to protect the right to trial by jury and ensure that injured people can pursue justice through the courts.

At DiCello Levitt, Gordon works with attorneys across the firm to develop and execute strategies involving the collection, management, review, and use of ESI in complex litigation. His practice includes matters involving data privacy, internet tracking, mobile devices, cryptocurrency, securities exchange platforms, automotive products, pharmaceuticals, security contractors, and food labeling. He also has extensive experience with document-review technology, predictive coding, search-term development, privilege issues, and complex document productions.
