Amy Keller was quoted in the article, “SCOTUS Nixes CareFirst Plea to Decide Data Breach Harm Standard,” published in Bloomberg BNA on February 20, 2018. The article addresses the Supreme Court’s decision not to settle the current circuit split over the level of harm a data breach victim must suffer in order to bring claims in federal court. Ms. Keller, co-lead attorney for plaintiffs in the ongoing data breach class action against Equifax, noted that “in the absence of government action, consumers can still rely upon private, civil lawsuits (such as class actions) to enforce their rights and seek damages for injuries that result from data breaches.”
