DiCello Levitt Settles Fair Labor Standards Act (FLSA) Case for $1.1 Million

On June 16, DiCello Levitt obtained a $1.1 million settlement on behalf of plaintiffs in a collective action lawsuit against VSE, XOTech Solutions LLC, and White’s Paint Blast LLC. The allegations included that the companies breached the Fair Labor Standards Act (FLSA) by requiring unpaid breaks.  Additionally, the workers claimed that they were entitled to an overtime rate of at least 1.5 times their regular rate of pay for each unpaid 15-minute break taken in any workweek in which they worked more than 40 hours.

The workers are represented by Laura E. Reasons, Kenneth P. Abbarno, and Mark M. Abramowitz of DiCello Levitt LLC.  The case is Waggoner, et al. v. VSE Corp., et al., Case Number 5:18-cv-00058 (E.D.
