What Happened?

Millions of drivers used GM vehicles with OnStar technology, unaware that their personal driving habits were being monitored and shared. According to the lawsuit, GM and OnStar collected detailed data—including acceleration, braking, speed, distance traveled, and vehicle identification numbers (VINs)—and provided that information to third-party data brokers like LexisNexis Risk Solutions and Verisk Analytics.

This allegedly unauthorized data exchange resulted in some consumers facing increased auto insurance premiums without knowing how or why their rates had gone up.

The Privacy Violations

The lawsuit accuses the defendants of violating consumer privacy laws by failing to obtain proper consent before collecting and sharing driving data. The plaintiffs also allege violations of consumer protection and wiretap laws. At its core, the litigation challenges the legality of turning drivers’ real-world behaviors into unregulated digital profiles sold to insurers.

DiCello Levitt filed one of the first class actions in this litigation and now holds a court-appointed leadership role as OnStar Track Co-Lead Counsel in the multidistrict litigation.
