Nov 04, 2024

On November 3, 2024, DiCello Levitt’s Bobby DiCello appeared on NBC’s Nightly News in a segment highlighting the latest in the case of Frank E. Tyson, a 53-year-old East Canton, Ohio resident who died on April 18, 2024, after being handcuffed and restrained with a knee to his upper back/neck by police while crying out, “I can’t breathe.”

On November 1, 2024, two Canton police officers were charged with reckless homicide in Frank’s death. On November 2, 2024, Bobby DiCello joined with the Tyson family for a press conference, accompanied by DiCello Levitt attorneys Ken Abbarno, Joe Fouche, III, and Jordyn Parks, as well as members of the clergy and representatives from the NAACP and Greater Stark County Urban League.

As shown in the NBC Nightly News segment, Bobby underscored how the indictment shows the officers were in the wrong. He is quoted saying, “Now we know who the bad guy is, and it wasn’t Frank.” Frank’s brother, John, also appeared in the newscast, “When a man says he can’t breathe—whether he can or not—him saying it should be an eyeopener.”
