DiCello Levitt Wins $5.7M Damages Award on Behalf of Client Bridgeway Diagnostics, LLC in Breach of Contract Trial Against Hitachi

CLEVELAND—In a major trial victory, a Cuyahoga County Court, Ohio jury sided with DiCello Levitt clients Dr. Jason Hoover and Bridgeway Diagnostics, LLC in awarding them a total of $5.7 million in damages.

The jury found that the defendants, Hitachi Healthcare Americas Corporation and Hitachi Medical Systems America, Inc., promised Dr. Hoover and his company Bridgeway Diagnostics a refurbished MRI device equipped with the “newest” generation technology currently on the market, yet in fact, delivered an older generation MRI without the promised tech.

Hitachi’s breach of contract and fraud caused not only financial hardship for Bridgeway Diagnostics but also personally devastated Dr. Hoover, who found himself unable to perform certain MRI scans that were urgently needed by its patients.
