DiCello Levitt’s Amy Keller is Co-Lead Counsel on Behalf of 4 Million Estimated Class Members
OAKLAND, Calif. – On August 17, 2026, a federal judge granted preliminary approval to a $100 million settlement in a class action lawsuit against Equifax brought by DiCello Levitt and co-counsel alleging it miscalculated credit scores affecting approximately 4 million people in 2022. This is the largest settlement in history related to the Fair Credit Reporting Act (FCRA) and a landmark achievement in consumer protection.
The class action lawsuit, In re: Equifax Fair Credit Reporting Act Litigation (Case No. 1:22-cv-03072), received preliminary approval by the Honorable Leigh Martin May in U.S. District Court for the Northern District of Georgia. A final fairness hearing is scheduled for January 22, 2027. DiCello Levitt Chicago Managing Partner Amy Keller, CIPP/US, serves as co-lead counsel in the litigation, working alongside co-counsel from Caplan Cobb, Gibbs Mura, and Girard Sharp.
What was the Equifax Credit Score Error Lawsuit About?
According to the lawsuit, Equifax misreported lowered credit scores for approximately 4 million Americans who applied for mortgages, auto loans, or credit cards between March 17 and April 6, 2022. As reported by the news, Equifax sometimes reported scores lowered by over 20 points, enough to cause lenders to deny credit or charge consumers higher interest rates.
The lawsuit alleged that Equifax was reckless in relying on antiquated legacy systems and inadequate testing systems, charging the company with violating the Fair Credit Reporting Act.
The $100 million settlement will provide direct cash payments to the approximately 4 million class members. The settlement fund is non-reversionary, meaning unclaimed funds will not go back to Equifax.
