Steven L. Groopman is a partner in DiCello Levitt’s Antitrust and Competition Litigation Practice Group and a seasoned class action attorney focused on high-stakes antitrust matters, with substantial experience in the health care sector. Recognized by Benchmark Litigation, The Legal 500, and Super Lawyers as a recommended lawyer in antitrust litigation and class actions, Steve represents union health and welfare benefit funds, consumers, small businesses, and other plaintiffs in cases involving complex markets, sophisticated corporate conduct, and significant economic harm.
Steve is known for developing and prosecuting cutting-edge, proprietary cases—often before the issues receive mainstream coverage. He has developed and litigated antitrust matters in a variety of sectors, including health insurance, pharmaceuticals, real estate, and airlines.
Steve is court-appointed Interim Co-Lead Counsel and leads DiCello Levitt’s team in In re CoStar Group Inc., et al., Antitrust Litigation, a multidistrict litigation challenging CoStar’s alleged monopolization of commercial real estate online listing and information services markets. The lawsuit, brought on behalf of commercial real estate brokers and other market participants, alleges that CoStar used its dominant position in platforms including LoopNet and CoStar to restrict customers’ ability to work with competitors, lock up customer data, shut out competition, and charge supracompetitive fees.
Steven also leads DiCello Levitt’s team in The Mayor and City Counsel of Baltimore v. Bausch Health Companies Inc., et al., alleging that defendants perpetrated a multifaceted scheme to delay and deter generic competition for the blockbuster IBS drug Xifaxan, including wrongfully listing various patents in the FDA’s Orange Book, entering into a reverse payment agreement with the first generic applicant to delay its market entry, and bottlenecking approximately a dozen subsequent generic applicants behind the first applicant.
Steve also serves on the Co-Lead Counsel team in In re Respimat Pharmaceuticals Antitrust Litigation, a nationwide antitrust class action alleging that the defendants wrongfully listed device patents in the FDA’s Orange Book, unlawfully delaying access to affordable generic alternatives for Combivent Respimat and Spiriva Respimat, two essential treatments for chronic obstructive pulmonary disease.
Steve maintains a broad-based practice but has a particular focus on investigating and challenging efforts by major pharmaceutical companies to undermine lower-cost generic and biosimilar competition. Steve also has deep experience in markets affecting homeowners, airline passengers, consumer borrowers, and small businesses. He has previously litigated antitrust and consumer claims involving residential real estate commissions, airline ticket pricing, online payday lending, and unlawful debt collection.
Before joining DiCello Levitt, Steve was a partner in the Boston office of an esteemed class action and complex litigation firm. Earlier in his career, he clerked for the Hon. Dickinson R. Debevoise of the U.S. District Court for the District of New Jersey, practiced at a litigation and white-collar defense boutique in New York, held legal internships focused on human rights and federal litigation, served as a student-attorney in an appellate defender clinic, and worked as a reporter-researcher at The New Republic.
Steve has previously been recognized by Benchmark Litigation as a Massachusetts Future Star and previously on its 40 & Under list in the plaintiff class action category. He has also been honored by Super Lawyers in the New England/Massachusetts jurisdiction and previously as a Rising Star.
