DiCello Levitt Secures Settlement With Boeing in Breach of Contract Case

Norwegian alleges Boeing engaged in a pattern of intentional misrepresentation and omission, gross negligence, and shoddy manufacturing.

DiCello Levitt secured a substantial confidential settlement in a case prosecuting economic loss and equitable claims on behalf of Norwegian Airlines (Norwegian Air Shuttle ASA and Arctic Aviation Assets DAC) against The Boeing Company and Boeing Commercial Aviation Services Europe Limited. The action, sought damages in excess of $1 billion, arose out of Boeing’s gross negligence, fraud, and breach of contract relating to its 737 MAX and 787 Dreamliner aircraft.

As the complaint alleged, Norwegian ordered large numbers of both aircraft types based on specific promises from Boeing. Instead of delivering what it promised, Boeing engaged in a pattern of intentional misrepresentation and omission, gross negligence, and shoddy manufacturing, producing aircraft with substantially impaired value and utility and, in the case of the MAX, tragic and deadly consequences.
