Class Action Alleges Price Fixing in Rental Equipment Market
CHICAGO – October 14, 2025 – On October 9, 2025, Judge Sara L. Ellis of the United States District Court for the Northern District of Illinois Eastern Division appointed DiCello Levitt and Berger & Montague to serve as Co-Lead Counsel in a consolidated class action against several major rental equipment companies over allegations of price fixing in the rental equipment market.
The lawsuit alleges defendants, including RB Global, Inc., Rouse Services LLC, Rouse Analytics, LLC, United Rentals, Inc., United Rental (North America), Inc., HERC Holdings Inc., HERC Rentals Inc, H&E Equipment Services, Inc., Sunstate Equipment Co., LLC, EquipmentShare.com, Inc., The Home Depot, Inc., and Home Depot U.S.A., Inc., among others, conspired to fix, raise, maintain, and stabilize rental prices for various rental equipment. The complaint details how the defendants exchanged competitively sensitive information through Rouse Services, facilitating an unlawful conspiracy to fix rental prices of equipment ranging from air compressors and generators to forklifts and excavators, among other equipment used for construction, manufacturing, entertainment, and other industries.
The case is In re Construction Equipment Antitrust Litigation, Case No. 1:25-cv-03487, in the United States District Court for the Northern District of Illinois Eastern Division.
