Class Action Targets Zillow’s Alleged Use of Hidden Agent Fees, Market Power To Inflate Home Prices Nationwide
The Honorable James L. Robart of the United States District Court for the Western District of Washington has appointed DiCello Levitt, together with Hagens Berman, as Interim Co-Lead Counsel in the consolidated class action, Taylor v. Zillow Inc., et al. The litigation alleges that Zillow, the nation’s dominant online real estate platform, has unlawfully leveraged its market power to inflate home purchase prices nationwide through a scheme involving undisclosed agent fees.
According to the complaint, Zillow’s “Flex” agent program steers homebuyers to Zillow-affiliated agents via prominent website prompts, while concealing the fact that these agents must pay up to 40% of their commission to Zillow—a cost never disclosed to buyers or sellers. Further, Plaintiffs allege that Zillow requires its agents to direct buyers to its own Zillow Home Loans, often providing consumers with higher loan interest rates, in violation of the Real Estate Settlement Procedures Act. Plaintiffs also seek damages through the Washington Consumer Protection Act, as well as unjust enrichment, disgorgement, and injunctive relief.
