DiCello Levitt Wins $5.7M Damages Award for Bridgeway Diagnostics in Breach of Contract Trial Against Hitachi

Feb 27, 2024

DiCello Levitt secured a major trial victory for client Bridgeway Diagnostics, LLC, as a jury in Cleveland, Ohio returned a verdict of over $3.7 million with an additional $2 million in punitive damages against Hitachi Healthcare Americas Corporation Inc.

In this case, Bridgeway Diagnostics and Dr. Jason Hoover were promised a refurbished MRI device equipped with the latest technology by Hitachi. However, they received an older generation MRI with significantly inferior capabilities, which had the effect of upending the practice at Bridgeway Diagnostics.

DiCello Levitt’s trial team, spearheaded by Peter Soldato and Justin Abbarno, presented Bridgeway Diagnostics’ case, focusing on  Hitachi’s decision to breach its deal with Bridgeway Diagnostics and commit fraud when called out. Dr. Jason Hoover, the founder of Bridgeway Diagnostics, emphasized the importance of integrity and genuine service when treating his patients, many of whom depend on his ability to offer lifesaving diagnostic services.

This victory underscores our firm’s commitment to advocating for justice on behalf of our clients, especially in complex commercial disputes.

The case is Bridgeway Diagnostics, LLC v. Hitachi Healthcare Americas Corporation, et al., CV-21-945745.
