DiCello Levitt secured a major trial victory for client Bridgeway Diagnostics, LLC, as a jury in Cleveland, Ohio returned a verdict of over $3.7 million with an additional $2 million in punitive damages against Hitachi Healthcare Americas Corporation Inc.
In this case, Bridgeway Diagnostics and Dr. Jason Hoover were promised a refurbished MRI device equipped with the latest technology by Hitachi. However, they received an older generation MRI with significantly inferior capabilities, which had the effect of upending the practice at Bridgeway Diagnostics.
DiCello Levitt’s trial team, spearheaded by Peter Soldato and Justin Abbarno, presented Bridgeway Diagnostics’ case, focusing on Hitachi’s decision to breach its deal with Bridgeway Diagnostics and commit fraud when called out.
